Abstract

This features a discussion of considerations in hiring and firing personnel without incurring legal difficulties. Comments by Paul Falcone, a faculty member in the University of California at Los Angeles’ Business and Management Extension Program, who has written two books on hiring good people and is currently writing a third on progressive discipline. Documentation is the key, and employees cannot be denied due process (being warned about the problem, identifying ways to fix the problem and establishing a reasonable amount of time for change to occur). Warnings must be both verbal and written. Other elements of due process are also discussed.
